These Terms of Service (Terms) govern your use of the Talk Arabic website and services.
The service is operated by Talk Arabic. In these Terms, "Talk Arabic", "we", "us" and "our" mean that operator. You can contact us at hello@talkarabic.co.
Governing law
These Terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that jurisdiction. International users may also have rights under the laws of their own country (for example, Turkey's KVKK or the EU GDPR); those rights are not affected by this clause.
Acceptance
By accessing the website, booking a lesson, or purchasing a lesson or package, you agree to these Terms. If you do not agree, please do not use the service.
Our service
We provide online Arabic lessons and lesson packages. Prices and what each option includes are shown on our pricing page and may change from time to time. We may update, add or withdraw lessons, packages or features.
Eligibility (18+)
The service is intended for adults aged 18 and over. We do not verify age. Anyone under 18 may use the service only with the consent and supervision of a parent or guardian, who accepts these Terms on their behalf.
We do not knowingly collect a child's personal information without that consent. If you believe we hold a child's information, contact us at hello@talkarabic.co and we will remove it.
Intellectual property
All content on the website and in our lessons — including course materials, lesson structures and methods, text, audio, video, recordings, images, code, designs and logos — is owned by or licensed to Talk Arabic and is protected by law.
Lessons and any recordings are provided for your own authorised, personal learning only. You must not:
- copy, reproduce, record, download, scrape or data-mine our content except as we expressly allow;
- reverse-engineer, decompile or attempt to extract our methods, materials or code;
- share, sell, sub-license, publish or redistribute our content; or
- use our content or methods to build, train or operate a competing product or service.
Acceptable use
You agree to use the service lawfully and respectfully. You must not:
- interfere with, disrupt, overload or attempt to gain unauthorised access to the website, accounts or systems;
- use the service to harass, abuse, threaten or harm teachers, staff or other learners;
- upload or transmit unlawful, infringing, malicious or misleading material; or
- impersonate any person or misrepresent your identity or affiliation.
Your consumer rights (Australian Consumer Law)
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot be lawfully excluded. Where such a guarantee or right applies, it prevails over anything inconsistent in these Terms.
Limitation of liability
To the maximum extent permitted by law, and subject to the consumer rights above:
- where a liability cannot be excluded but can be limited, our liability for the services is limited, at our option, to re-supplying the services or paying the cost of having them re-supplied; and
- we are not liable for any indirect, special or consequential loss, or for loss of profits, data or opportunity, to the extent the law allows us to exclude it.
Suspension and termination
We may suspend or terminate your access to the service if you breach these Terms, misuse the service, or where we are reasonably required to do so by law. Where it is reasonable to do so, we will give you notice. Terms that by their nature should survive (including intellectual property, consumer rights and liability) continue after termination.
Changes to these Terms
We may update these Terms from time to time. The current version will be posted on the website with a new "Last updated" date, and your continued use of the service after that date means you accept the updated Terms.
